AmeriBar Payment Plan Terms

This agreement is entered into by AmeriBar, a bar exam study program provider, and you (the “Student.”). AmeriBar provides a bar exam study program (the "Program").  This Monthly Payment Plan (the "Plan") establishes the terms and conditions of the sale of AmeriBar's study program.

1.             Scope of Agreement:

The Student agrees to purchase AmeriBar's study program for the jurisdiction and exam administration indicated in the shopping cart receipt provided to the customer.

2.             Costs Due at Time of Enrollment:

Upon acceptance of this agreement, the Student’s credit card will be charged a non-refundable initial payment of $203.00, a finance charge of $50.00, plus applicable shipping and handling costs. This initial payment is not refundable under any circumstances and will be credited toward the balance.

3.             Remaining Costs

The remaining cost of the study program ($792) will be charged to the credit card you use to pay the initial payment. The Student’s credit card will be charged automatic monthly payments of $99 for eight consecutive months beginning 30 days from the date you pay your initial payment.

4.             Credit Card on File

It is the student's responsibility to ensure that the credit card provided to AmeriBar 1) will not expire before the conclusion of the payments set forth in this Plan; and 2) will have sufficient funds to be drawn from the card for the monthly payments.

If the Student needs to change the credit card on file after you place your order, you must contact AmeriBar by telephone immediately.  AmeriBar will not be responsible for any charges incurred to the student's account due to an overdraft.

5.             Failure of the Make Payment of the Remaining Cost:

Failure to make or allow for payments as provided for in the Plan is a breach of the Plan.  Any such breach will be reported to the Board of Bar Examiners. The Student will be responsible for any additional costs incurred by AmeriBar in collecting payment pursuant to the Plan.

6.             Pass/Update Guarantee

If you fail the bar examination indicated in the shopping cart receipt, you will qualify for continued online access to AmeriBar's online lectures and any relevant updates for the next bar exam administration.  An AmeriBar representative will also be happy to review the Student’s score report and discuss the scores with the Student for no additional cost.  If the student is to receive any updated materials, the Student must pay shipping and handling charges for any updated materials. You must contact AmeriBar within 30 days of receiving notification from the Bar Examiners and provide a fax copy of the notification from the Board of Bar Examiners.

AmeriBar will provide you with a course to assist you in preparing for the bar exam.  However, as we are not taking the exam for the Student or requiring the student to study appropriately, AmeriBar cannot guarantee that the Student will pass the bar exam. The Plan provides the Student with specific rights under the Plan.  These are the only available remedies in the event the Student fails the bar exam.  

7.             Modification and Dispute

Any modifications to the Plan must be in writing and must be signed by both AmeriBar and the Student. In the event of any dispute regarding the Plan, any recovery for damages of any kind will be limited to the amount actually paid by the Student to Ameribar under the Plan.
